1. Introduction

Welcome to Better Bud (we, us, our). These Terms apply to all users of our services and platforms (you, your). By using our services, you agree to be bound by these Terms and our
Privacy Policy.

Key definitions:

  • Services: our clinic, telehealth, and related services.
  • Clinic Services: consultations provided by healthcare practitioners.
  • Healthcare Practitioners: doctors, registered nurses, or enrolled nurses engaged by us.
  • Pharmacy: any registered pharmacy we partner with to dispense prescribed medicines.
  • Medicine: medicines prescribed by a practitioner following your consultation.

2. No Emergency Services

Our services are not intended for urgent or emergency care. If you require emergency medical assistance, call 000 or attend the nearest hospital emergency department.

If our staff identify that you may be at immediate risk of harm to yourself or others, we may contact emergency services.

3. Our Services

We provide access to telehealth consultations with healthcare practitioners. Prescriptions may only be issued at the sole discretion of the practitioner and will not be issued if deemed
clinically inappropriate.

If a prescription is issued, you:

  • Consent to us sharing your prescription and necessary health information with one of our registered partner pharmacies.
  • Authorise that pharmacy (or its delivery partners) to dispense and deliver your medicine to you.
  • Acknowledge and waive any objection to us choosing the dispensing pharmacy, provided it is a registered Australian pharmacy.
  • Accept that once medicine has been dispensed and dispatched, responsibility for delivery lies with the dispensing pharmacy and delivery provider. We may, at our discretion, refuse, reschedule, or discontinue services at any time.

4. Your Obligations

You must:

• Provide accurate, current and complete information, including health history and medication use.
• Follow the advice and treatment plans of our healthcare practitioners, including attending follow-ups as advised.
• Use prescribed medicines only for yourself and as directed.
• Store medicines securely and prevent access by others.
• Inform us promptly of any side effects or adverse events.
• Treat our staff, partners, and suppliers with respect and courtesy.

You must not:

• Withhold relevant medical information.
• Seek prescriptions through deception or “doctor shopping.”
• Abuse, threaten, or harass staff or partners.

5. Eligibility

You may only use our services if you:

• Are at least 18 years old.
• Reside in Australia and have an Australian residential address.
• Have the legal right and capacity to enter into these Terms. Each time you use our services, you warrant that these conditions are true.

6. Fees & Payment

Consultation fees are payable at booking and cover the time and expertise of the practitioner, not the outcome.
Fees do not include the cost of any medicine or delivery, which are charged separately by the dispensing pharmacy.

Refunds will only be provided if:

• After your first consultation, our practitioner determines services are not appropriate for you; or
• We cancel your consultation and cannot reschedule within a reasonable timeframe. All other refunds are at our absolute discretion

7. Privacy & Data Sharing

We collect, use, and share your information in accordance with our Privacy Policy. By using our services, you consent to us sharing your information with partner pharmacies, delivery
providers, and service partners as required to facilitate your care, comply with regulations, or provide services.

8. Limitations of Service

• Prescriptions are issued solely at the discretion of the healthcare practitioner.
• We do not guarantee suitability, availability, or effectiveness of any medicine.
• Our services are not a substitute for the ongoing care of your GP or specialist. You remain responsible for your broader healthcare needs.
• We are not responsible for delays, shortages, or delivery issues once medicine is dispatched by a pharmacy.
To the maximum extent permitted by law, Better Bud is not liable for any loss, damage, or injury (direct or indirect) resulting from your use of our services, platform, or medicines

9. Indemnity

You agree to indemnify Better Bud, our staff, contractors, and partner pharmacies against any claims, losses, costs, or damages (including legal costs) that arise from:
• Your breach of these Terms.
• Misuse or unauthorised use of prescribed medicines.
• Providing false, misleading, or incomplete information.
• Any unlawful use of our services.

10. Termination

We may suspend or terminate your access if you breach these Terms, misuse our services, or if we reasonably suspect misuse or diversion of prescribed medicines.

11. Intellectual Property

All materials, text, graphics, software, and content provided through our platforms are owned or licensed by Better Bud. Unauthorised use is prohibited

12. General

We may amend these Terms at any time. Updated Terms take effect when published on our platform. Continued use of our services means you accept the changes.

These Terms are governed by the laws of South Australia, Australia. You submit to the exclusive jurisdiction of the courts of South Australia
